What is Estate Planning?
The purpose of estate planning is, to preserve accumulated assets from a lengthy Probate system and avoid unnecessary taxes.
The main document involved is a Living Trust which ensures that assets go directly to the Beneficiaries, typically the Trustors’ children. The process of succession is not only swift but also private and does not involve any court proceeding. It therefore saves a lot of money for the parents’ heirs.
As part of our portfolio of estate preservation documents, King, King & King provides a Pour-Over Will which serves the purpose of transferring assets, inadvertently left out of the Trust, into the Trust, and also Durable Powers of Attorney for Assets, an Advance Health Care Directive and a Nomination of Conservator to appoint a person who will take care of the Trustor’s assets and person in case of incapacitation.
Trusts are not just for the very wealthy. Everyone needs one if heirs are to be spared the traumas of the Probate system.
As Donald Trump puts it: “Everybody needs a Living Trust.”
